These Terms of Use (“Terms”) are a legal agreement between you and Azorean Studios (“we”, “us”), covering the SoMi mobile application and this website (together, the “Service”). By downloading, installing or using SoMi you agree to these Terms. If you do not agree, do not use the Service.
1. SoMi is not medical care — read this one
SoMi is a general wellbeing app. It is not a medical device, it is not therapy, and it does not provide medical, psychological or other professional advice. Nothing in the Service is intended to diagnose, treat, cure or prevent any condition. SoMi draws on polyvagal-informed somatic practice, which is a framework for organising exercises — not a clinical claim about outcomes in your body.
You use the exercises at your own risk. Consult a qualified healthcare professional before starting if you are pregnant, have a cardiovascular, blood pressure, neck, spine, eye or inner-ear condition, have a seizure disorder, or are being treated for a mental health condition — including trauma, PTSD, or dissociative symptoms. Stop immediately if you feel pain, dizziness, faintness, or distress that does not settle, and seek help.
In an emergency, call your local emergency number. SoMi is not a crisis service, does not monitor what you write, and cannot respond to a request for help. Our fullhealth disclaimer forms part of these Terms.
2. Who can use SoMi
You must be at least 13 years old to create an account, and at least 16 in regions where that is the minimum age to consent to data processing. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian who agrees to these Terms on your behalf. You must be able to form a binding contract and must not be barred from using the Service under applicable law.
3. Your account
You need an account to use SoMi. You can create one with an email address and password, or with Sign in with Apple. You agree to provide accurate information, to keep your credentials secure, and to tell us promptly at connect@azorean.io if you believe your account has been accessed by someone else. You are responsible for activity that happens under your account.
You can delete your account at any time from inside the app. Deletion is permanent and removes your practice history — seeaccount deletion.
4. Price
SoMi is currently free to download and use. There are no in-app purchases, no subscriptions and no advertising. If we ever introduce paid features, we will publish updated Terms describing the pricing, billing and cancellation arrangements before those features go live, and existing free functionality will not be retroactively placed behind a paywall without notice.
5. Your licence to use SoMi
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use SoMi on Apple devices you own or control, for your own non-commercial use, as permitted by the App Store Terms of Service.
6. What you may not do
You agree not to:
- copy, record, download, redistribute, publicly perform or resell the exercise videos, audio, or any other content in the Service;
- reverse engineer, decompile or attempt to extract the source code of the app, except to the extent that restriction is prohibited by law;
- access the Service through automated means, scrape it, or attempt to access data belonging to another user;
- interfere with, overload, or attempt to breach the security of our systems;
- use the Service to deliver somatic or therapeutic instruction to others commercially, or hold yourself out as certified by us;
- use the Service in violation of any applicable law.
7. Content
Ours
The Service, including the exercise videos, voice-over recordings, music, text, design, the SoMi name and logo, and the software itself, is owned byAzorean Studios or our licensors and is protected by copyright, trademark and other laws. These Terms do not transfer any ownership to you.
Yours
Your check-ins, tags and journal entries remain yours. You grant us only the limited licence necessary to store, process and display that content back to you within the Service — for example, to render your calendar and history. We do not publish it, share it with other users, sell it, or use it to train anything.
8. Availability and changes
We may add, change, suspend or discontinue any part of the Service at any time. We may release updates, and some updates may be required for the app to keep working. We do not promise the Service will be uninterrupted or error-free, and features present today may not be present tomorrow.
9. Termination
You may stop using SoMi and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. Sections 1, 7, 10, 11, 12 and 13 survive termination.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranty that the Service will produce a particular result in your body or state of mind. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Azorean Studios will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of or inability to use the Service. Our total aggregate liability arising out of or relating to the Service will not exceed one hundred United States dollars (US$100), or the amount you paid us in the twelve months before the claim, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
12. Indemnity
You agree to indemnify and hold harmless Azorean Studios and its officers and contractors from any claim or demand, including reasonable legal fees, arising out of your misuse of the Service or your breach of these Terms or of any law.
13. Apple-specific terms
You acknowledge that these Terms are between you and Azorean Studios only, and not with Apple Inc. Apple is not responsible for the Service or its content. Apple has no obligation to furnish any maintenance or support for the Service. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price paid for it — which, SoMi being free, is nothing; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory compliance, or intellectual property infringement claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles, California, for any dispute not subject to arbitration or small claims. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings locally, nothing here removes that right or the protection of mandatory consumer law where you live.
15. Everything else
If a provision of these Terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger or sale of assets. These Terms, together with thePrivacy Policy and theHealth Disclaimer, are the entire agreement between us regarding the Service.
We may update these Terms. Material changes will be notified in the app or by email before they take effect, and the date at the top of this page will change. Continuing to use the Service after that means you accept the updated Terms.
